DMS NPC has been appointed by the National Department of Cooperative Governance to examine and identify National Legislation in terms of the Application of Section 2(1)(b) of the Disaster Management Act, 2002.

Project Information:

Phase 1: Analyse list of hazards that may lead to a disaster.
Phase 2 - Desktop review and analysis, focusing on:

  • Searching legislative databases and all the National Sector department websites to identify national legislation, Regulations and legal precedent aimed at occurrences falling within the definition of a “disaster” in section 1 of the Act, to the extent that that occurrence can be dealt with effectively in terms of other national legislation aimed at reducing the risk, and addressing the consequences, of occurrences of that nature.
  • Populating the output table in the format agreed with the NDMC in phase one.
  • Obtaining soft copies of the national legislation, Regulations and legal precedent identified in (a) above.
  • Preparing the suggested assignment of and guidelines for legislation identified in terms of the analysis in terms of section 2(2).
  • Preparing and submit a progress report every month during this phase.
Phase 3 - Briefing and reporting to the NDMC, including:

  • Presenting the analysis in terms of Section 2(1)(b), and the suggested assignment of and guidelines for legislation identified in terms of section 2(2), to the NDMC in a consultative session.
  • Considering the inputs made by the NDMC.
  • Drafting and where needed inserting the recommendations in the final text of the report (including the output table).
  • Submitting the final report to the NDMC in hard and soft copies as required including the soft copies of the national legislation, Regulations and any legal precedent identified.
